Transgender Law Center joined the American Civil Liberties Union, Lambda Legal, National Center for Lesbian Rights, and GLBTQ Legal Advocates and Defenders in a letter to Attorney General Loretta Lynch and White House counsel Neil Eggleston, urging the Obama administration to make it clear that North Carolina’s HB2 and similar laws being considered by other states violate federal law and should put federal funding for those states in jeopardy.

As the letter states, HB2 “mandates systemic, statewide violation of federal laws that prohibit sex discrimination, including both Title VII and Title IX.” Under Title IX, as interpreted for years by the federal government and made clear in a recent Fourth Circuit Court of Appeals ruling, schools cannot ban transgender students from using the restrooms that match their gender identity. North Carolina is currently in line to receive $4.5 billion in federal education funding next year, which should now be at risk under HB2.
