Transgender Law Center was part of a group of 29 national civil rights organizations that submitted an amicus brief to the Ninth Circuit in Golinski v. U.S. Department of Personnel Services, a case brought by Lambda Legal challenging the federal Defense of Marriage Act (DOMA). The amicus brief argues that laws like DOMA that discriminate based on sexual orientation should be subject to the highest level of scrutiny under the Constitution. This issue is of particular importance to the trans community because employers and government agencies often mistakenly use DOMA and other laws barring same-sex marriage to deny recognition to marriages involving transgender people. The brief was drafted by the ACLU, Gay & Lesbian Advocates & Defenders, and the National Center for Lesbian Rights.
