Today, following months of input and advocacy from Transgender law Center, the CA Fair Employment and Housing Council (FEHC) has put new regulations into effect. The regulations clarify the law to reflect the most common forms of discrimination transgender and gender nonconforming people face at work, especially usage of sex-segregated facilities, name and pronoun use (including nonbinary pronouns), and gendered dress codes.
While these forms of discrimination are already illegal under Title VII, by explicitly naming them the new regulations make clearer what rights trans and gender nonconforming employees have, what obligations employers have, and that employers can be held accountable for violating those obligations.
