View Credible Fear Interviews: What You Need to Know as a TGNC Immigrant
(Oakland, CA) – Today, Transgender Law Center released two resources in English and Spanish for immigrants in the transgender community to know their rights in the case of raids by Immigration and Customs Enforcement (ICE). This follows the Trump administration’s reversal of the Deferred Action for Childhood Arrivals (DACA) program on Tuesday, leaks of a planned and allegedly canceled “mega” raid, and months of increased targeting of immigrant communities.
“For many transgender and gender nonconforming immigrants, deportation could well be a death sentence,” said Isa Noyola, deputy director at Transgender Law Center. “We have a president who campaigned on the destruction of immigrant communities, and he clearly will not stop at DACA. Transgender immigrants have rights, including the right to seek asylum, and we will do everything in our power to make sure our community’s prepared for the next attack from this government, whatever form it may take.”
The first resource outlines ways to prepare for potential raids and the specific rights of transgender and gender nonconforming people confronted by ICE officials. The second resource shares tips for transgender immigrants who are granted “credible fear interviews” due to fear of persecution or violence should they be deported.
The resources were prepared through Transgender Law Center’s Trans Immigrant Defense Effort (TIDE), a program that connects transgender immigrants to pro bono attorneys. TIDE is currently working with trans DACA recipients seeking other avenues of immigration relief, and advocating for the release of a group of transgender women seeking asylum who presented themselves at the border as part of the first trans-gay caravan last month.
