In response to President Trump’s nomination of Neil Gorsuch, a Judge of the 10th Circuit Court of Appeals, to the Supreme Court of the United States, Transgender Law Center has decided for the first time to oppose a Supreme Court nomination upon its announcement. “We oppose the nomination of Neil Gorsuch to the Supreme Court of the United States. His record as a judge reveals that his radical views are far outside the mainstream, and would give a green light to discrimination against transgender people as well as other vulnerable communities who rely on the principle of equal protection enshrined in the Constitution. In one particularly troubling decision, he found no problem with an Oklahoma prison’s decision to deny a transgender woman medically necessary hormone treatment or women’s clothing. In another, he described employer coverage of birth control as ‘assist[ing] others in committing wrongful conduct.’ With so much at stake for our communities in the coming months and years, the courts must remain an independent bulwark for resistance to unconstitutional and illegal discrimination in all forms. Judge Gorsuch’s record shows that he would approve, rather than stand up to, discrimination. The Senate should reject this nomination.”
